Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of Applianz websites, software, and services (the “Services”). By accessing or using the Services, you agree to these Terms.

2. Services

• SaaS subscriptions: access to hosted software features for a subscription period.
• Development services: portal/web app development, customization, consulting, integration, and maintenance.

Where development work is provided, a proposal, statement of work (SOW), or order form may specify scope, milestones, timelines, and acceptance criteria. If there is a conflict, the SOW/order form prevails for that engagement.

3. Accounts and responsibilities

• You are responsible for your credentials and all activity under your account.
• You must provide accurate, current information.
• You must comply with applicable laws (including data protection laws).

4. Acceptable use

• No unlawful, harmful, abusive, or fraudulent use.
• No attempts to bypass security or access controls.
• No interference with the Services (including malware or automated abuse).
• No reverse engineering except as permitted by mandatory law.

5. Fees, payments, and subscriptions

• Fees are shown at checkout and/or in your order form.
• Payments may be processed by third-party providers (e.g., Mollie).
• Subscriptions may renew automatically unless cancelled before the next billing date (where supported).

6. Cancellation

You may cancel according to options available in your account or by contacting us. Cancellation stops future renewals; access may remain available until the end of the paid period unless otherwise stated.

7. Refunds

Refund terms are described in our Refund Policy, which forms part of these Terms.

8. Intellectual property

• Applianz retains all rights in the Services, documentation, and underlying technology.
• Client-specific deliverables may be licensed or assigned as specified in an applicable SOW/order form.
• You grant Applianz a limited right to host and process your content solely to provide the Services.

9. Disclaimers

The Services are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied.

10. Limitation of liability

To the maximum extent permitted by law, Applianz will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, or goodwill. Our aggregate liability will not exceed the fees paid for the relevant Service in the 12 months preceding the event giving rise to the claim, unless mandatory law requires otherwise.

11. Governing law

These Terms are governed by the laws of Estonia. Disputes shall be submitted to the competent courts in Estonia, unless mandatory consumer protection laws provide otherwise.
